GENERAL

The us.isseymiyake.com web site (the “Site”) is owned and operated by, and is a service of, ISSEY MIYAKE U.S.A. CORP. (“Issey Miyake USA” or “we”), which is the subsidiary of ISSEY MIYAKE INC.. These Conditions of Service, along with any other terms and conditions that may appear on the Site from time-to-time (collectively, "Conditions"), set forth the terms and conditions under which you may use and access the Site.

We may also provide you access to our free connected clienteling services (the “Services”). Use of the Services is also governed by these Conditions. To use the Services, you may register with a sales associate via a QR code either in a store or via a remote sign-up link. Once you register and agree to these Conditions, you will be sent external URLs to view curated style guides, product information, and to like and dislike items, expressing your preferences to your sales associate. All client communication and client data that is shared with the sales associate will be tracked and stored by the sales associate.

THESE CONDITIONS CONTAIN WARRANTY AND LIABILITY DISCLAIMERS. BY ACCESSING THE SITE AND/OR USING THE SERVICES, YOU AGREE TO THESE CONDITIONS. IF YOU DO NOT AGREE TO THESE CONDITIONS (WITHOUT MODIFICATION), YOU ARE NOT AUTHORIZED TO ACCESS OR OTHERWISE USE THE SITE OR THE SERVICES. In the event of a violation of these Conditions, Issey Miyake USA reserves the right to seek all remedies available by law and in equity. You are invited to read them carefully and print a copy for future reference.

TRANSACTIONS THROUGH THE SITE AND/OR THE SERVICES

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

RIGHT TO CHANGE THE SITE AND/OR THE SERVICES

We reserve the right, at any time in our sole discretion, to modify, suspend or discontinue the Site, the Services, or any service, content, feature or product offered through the Site or the Services, with or without notice; and/or offer opportunities to some or all users of the Site or the Services.

You agree that we will not be liable to you or to any third party for any modification, suspension or discontinuance of the Site, the Services, or of any service, content, feature or product offered through the Site or the Services.

USE OF THE SITE, THE SERVICES, AND THEIR CONTENT

Use of Site: You may access and use the Site and the Services solely for your personal use in accordance with these Conditions. You agree not to access or use the Site or the Services in any manner that is prohibited by these Conditions or is otherwise unlawful. We reserve the right, in our sole discretion, to terminate or suspend your access to, and/or use of, the Site or the Services, or any portion thereof, at any time, with or without notice and for any reason (or no reason), and you agree that (a) if your authorization to access the Site or the Services is terminated, you will not thereafter access, or attempt to access, the Site or the Services, directly or indirectly, and (b) if your authorization to access the Site or the Services is suspended, you will not thereafter access, or attempt to access, the Site or the Services, directly or indirectly, until your suspension is removed and we give you express notice thereof.

All rights and licenses not expressly conferred by these Conditions remain with Issey Miyake USA, its content providers, or its service providers.

RESTRICTIONS ON USE OF THE SITE, THE SERVICES, AND THEIR CONTENT

All content included on the Site or provided through the Services, including but not limited to works, images, pictures, dialogues, music, sounds, videos, documents, drawings, figures, logos, menus, web pages, graphics, colors, schemes, tools, fonts, designs, diagrams, layouts, methods, processes, functions and software (collectively, the "Content"), is the property of Issey Miyake USA or its content suppliers and is protected by national and international copyright and other intellectual property laws. You may not reproduce, publish, distribute, display, modify, create derivative work from, or exploit in any way, in whole or in part, the Content without the prior express written consent of Issey Miyake USA or its content suppliers, as the case may be. You may not frame or use framing techniques to misappropriate any trademark, logo, or other proprietary information (including images, text, page settings, or format) without the express written consent of Issey Miyake USA or its content suppliers, as applicable.

Issey Miyake USA and its content suppliers shall have the exclusive right to authorize or prohibit in their sole discretion any reproduction, publication, distribution, display, modification, creation of derivative work from, or exploitation in any way of, in whole or in part, the Content. Any reproduction, publication, distribution, display, modification, creation of derivative work from, or exploitation in any way of, the Content expressly authorized in writing by Issey Miyake USA or its content suppliers shall be carried out by you for lawful purposes only and in compliance with all applicable laws.

You also acknowledge that it is forbidden to upload content that is illegal and contrary to national and international laws. You may not to use the Site or the Services in such a way as to cause, or be likely to cause, interruptions, damage or malfunctions to the Site or the Services and their functionalities, or for fraudulent purposes, or to commit unlawful activities, or to cause disturbance, prejudice, or apprehension.

You will not attempt to scrape or reverse engineer the Site or the Services or otherwise try to circumvent our intellectual property rights.

If you use the Services, you must not use expressions that are disparaging, defamatory or illicit in your private messaging with your sales associate.

"ISSEY MIYAKE" is a registered trademark and/or service mark in the United States of America and/or other countries, owned by ISSEY MIYAKE INC. All rights are reserved. These and any other trademark or service mark of ISSEY MIYAKE, including, but not limited to any mark that incorporates the words "ISSEY MIYAKE" or any form of the domain name "us.isseymiyake.com", may not be used in any manner for any purpose without the prior express written consent of Issey Miyake USA.

UNITED STATES AND CANADA SHIPMENTS ONLY

Purchases on this site may be made by residents of the United States and Canada only. We are unable to deliver online purchases outside of the United States and Canada at this time.

AGE RESTRICTIONS FOR USE OF THE SITE AND THE SERVICES

You must be 18 years of age or older to order from the Site. By accepting these Conditions, you confirm that you are 18 years of age or older.

PERSONAL INFORMATION SUBMITTED THROUGH THE SITES AND/OR THE SERVICES

Your submission of personal information through the Sites is governed by our privacy policy, which can be reached by clicking on the "Privacy Policy" link located in the footer section of the Sites (the "Privacy Policy"). These Conditions incorporate by reference the terms and conditions of the Privacy Policy.

AVAILABILITY OF PRODUCTS, THE SITE, AND THE SERVICES

You acknowledge and accept that the technical characteristics and/or functionality of the Site and the Services may be modified at any time.

In addition, we reserve the right to suspend and/or cancel your account, block access to the Site or the Services, in whole and/or in part, temporarily and/or permanently, in the event of a breach by you of any of the obligations set out in these Conditions or the Privacy Policy.

You also acknowledge that products are available for purchase online at the Site or through the Services subject to availability. Issey Miyake USA reserves the right to alter the terms or duration of any special offer or sales promotion. Issey Miyake USA will inform the customer if an order cannot be fulfilled.

AUTHENTICITY

Issey Miyake USA guarantees the authenticity of all products purchased through the us.isseymiyake.com web site or sold through the Services.

COLORS

We have made every effort to display as accurately as possible the colors of the merchandise that appears on the Site. We cannot guarantee that your computer or handheld device will accurately display any color.

CONTRACT OF SALE

An email confirmation will notify the customer as soon as an order has been accepted and processed. Upon receipt of the confirmation email, you are required to verify the contents and immediately notify customer service of any discrepancies that are discovered.

PRICES

All prices on the Site are in US Dollars. Prices may change without notice. Issey Miyake USA reserves the right, at its sole discretion, to not process or to cancel any orders placed for a product or service whose price was incorrectly posted on the site as a result of an error. If this occurs, Issey Miyake USA will notify the customer by email.

SALES TAX

Items ordered from the Site that are shipped within New York State are subject to New York sales tax. Your applicable sales tax will be automatically calculated and added to your order during checkout.

CANADIAN DUTIES AND TAXES

Items ordered from the Site that are shipped to Canada are subject to local Canadian duties and taxes. The applicable duties and taxes are not included in the order total. It is the receiver’s responsibility to pay all related duties and taxes associated with the order directly to DHL prior to delivery.

GIFT CARDS

We are pleased to offer digital gift cards for purchase exclusively through our Online Store.

Our digital gift cards are redeemable for purchases made through us.isseymiyake.com and are not available in physical format. Gift cards purchased through us.isseymiyake.com may only be redeemed through our U.S. Online Store and are not valid for use on other ISSEY MIYAKE websites.

Gift cards do not expire and may be used toward multiple purchases until the available balance has been exhausted. If the purchase amount exceeds the available gift card balance, the remaining balance may be paid using another accepted payment method. Gift cards cannot be used to purchase additional gift cards.

All gift card purchases are final sale and cannot be returned, refunded, or exchanged for cash. Gift cards cannot be replaced or refunded if lost, stolen, or used without authorization. ISSEY MIYAKE is not responsible for any unauthorized use of a gift card.

MODIFICATIONS

We reserve the right to change the Site, the Services, these Conditions and/or the Privacy Policy at any time to offer new products or services, or to comply with legal or regulatory requirements. You will be subject to the policies and terms of the then-current Conditions in force. BY CONTINUING TO USE THE SITE AND THE SERVICES AFTER THE ENTRY INTO FORCE OF ANY CHANGES, YOU FULLY ACCEPT THESE CHANGES. IF YOU DO NOT WISH TO ACCEPT THE CHANGES, YOU MAY NOT USE THE SITE OR THE SERVICES.

WAIVER

In case of a violation of these Conditions by you, our non-exercise of the right to take legal action against you does not constitute a waiver of our right to take legal action for the violation.

SEVERABILITY

If any provision of these Conditions is held or becomes invalid or unenforceable under applicable law, the invalidity or unenforceability of that provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

GOVERNING LAW

These Conditions are governed by and shall be construed in accordance with New York law. The state and federal courts of New York shall have exclusive jurisdiction over any matters relating to these Conditions.
